Terms of Service

1.About these terms

These terms apply when you use bloomvox.com, request a Bloomprint, buy a service or use the client portal. By doing any of these, you agree to them on behalf of yourself and the business you represent. A signed agreement or order form with us takes priority where it differs.

2.Your free Bloomprint

A Bloomprint is a free assessment built from public information about your business. It's our professional opinion, provided for your information. It isn't a guarantee of rankings, inquiries or revenue, and parts we couldn't check are marked as not checked. You're free to act on it with or without us.

3.Services, pricing and payment

Each service's scope, monthly price and any implementation fee are shown before you buy, and confirmed in your order. The service details page for your service (monthly quantities, inclusions, exclusions, onboarding needs and how we work) forms part of these terms, in the version recorded with your order. Later changes to that page don't change your agreement unless we both agree in writing. Prices are in US dollars and exclude taxes, ad spend and third-party costs unless stated.

Services are billed monthly in advance through Stripe, starting on the day you buy. The implementation fee, where there is one, is charged with the first month. Your service renews automatically each month until it's cancelled as described below.

We may decline an application or refund a purchase if the service isn't a fit or we can't start your service, in which case you're not charged, or you're refunded in full.

4.Minimum term, cancellation and refunds

• Growth Engine and Revenue Accelerator start with an initial term of three months. After that they continue month to month.
• All other services are month to month from the start.
• You can cancel at any time with 30 days' notice by emailing us or through the portal. Cancellation takes effect at the end of the billing period after your notice, and not before an initial term ends.
• Fees already paid, including the implementation fee, aren't refundable, except where the law requires it or where we decline or can't start your service, in which case we refund in full.
• If we materially fail to deliver what your service includes and don't fix it within 30 days of your written notice, you can cancel immediately and we'll refund the unused part of the current month.

5.How we work together

You approve everything before it's published or sent in your name, and you're responsible for the accuracy of facts, claims and offers you approve. You'll give us the access, information and timely feedback the work needs. We never ask for your passwords: we use invited access or official connections that you can revoke at any time.

We don't send cold email in your name, and we only email people who've chosen to hear from you.

6.Content and ownership

Once you've paid for it, the content we create for you is yours. We keep ownership of our own tools, templates, methods and know-how, and may describe the kind of work we do for you without sharing your confidential information. We'll only name you as a client with your permission.

Each of us keeps the other's confidential information private and uses it only for our work together.

7.Results

Marketing results depend on your market, offer, sales follow-through and things outside anyone's control. We commit to doing the work in your service well and reporting honestly on what we can measure. We don't guarantee leads, rankings or revenue.

8.Acceptable use

Don't misuse the site or portal: no attempts to break security, scrape, overload, or access other clients' information, and no unlawful, misleading or infringing content. We may suspend access that puts the service or other clients at risk.

9.Responsibility and liability

We provide the site and the Bloomprint as they are. To the extent the law allows, neither of us is liable for indirect or consequential losses, and our total liability for any claim is limited to the fees you paid us in the three months before it arose.

10.Governing law

These terms are governed by the laws of the State of Washington, United States. Any dispute will be handled in its courts, unless the law where you live gives you other rights.

11.Updates and contact

We may update these terms. We'll change the date above, and give clients 30 days' notice of changes that affect their service. Contact: hello@bloomvox.com.
